欧盟数据治理域下再利用数据的经验与启示

摘要：欧盟于2020年出台了《数据治理法》以明确数据治理新措施“数据再利用”，欧盟数字主权取得进一步发展。本文通过分析对再利用模式运作中双重逻辑，指出该法案象征着数据利他主义概念在欧盟数据治理域下的正式确立，并得出对我国数据治理具有启发性的三点：明确数据治理中数据类型范围、数据使用需兼顾数据保护以及先行完善数据共享的统筹规划。

Experience and enlightenment of reusing data in the European Union data governance

Abstract：The European Union issued the Data Governance Act in 2020 to clarify the new measures of data governance: data reuse, announcing the further development of the European Union′s digital sovereignty. By analyzing the dual logic in the operation of the reuse model and summarizing the key points in the model, this paper points out that the bill symbolizes the formal establishment of the concept of data altruism in the European Union data governance domain, and draws three enlightening points for China′s data governance: clarifying the scope of data types in data governance and using, taking data protection into account and first improving the overall planning of data sharing.

0 引言
信息时代环境下，数据在各行业运行理念中逐渐占据主导地位，表现出其资源性的一面。数据治理概念域下，面对海量生产的数据，如何合法安全地管理和使用这些数据成为新的难题。
《通用数据保护条例》（GDPR）为欧盟数据治理战略中的第一部法案，《数据治理法》（DGA）的出台为欧盟数据治理提出了一套政府部门外“再利用”（Reuse，亦称重用）数据的全新模式，其中明文规定了可再利用数据资源范围，以及以数据利他主义和信任原则为基础的政府内外两套数据再利用服务运作框架，并设立全新数据创新委员会予以管理，即政府设立单独部门进行“专事专办”。本文基于《数据治理法》内容，分析欧盟现行数据治理运作特点，以期为我国数据治理提供借鉴与启示。
